These Terms of Service constitute a legally binding agreement between you ("User," "you," or "your") and Bigger Than Hoop Dreams Inc. ("BTHD," "Company," "we," "us," or "our"), a corporation incorporated under the laws of Ontario, Canada, governing your access to and use of the BTHD mobile application and website located at www.bthd.app (collectively, the "Platform").
By creating an account, downloading the application, or accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
Bigger Than Hoop Dreams Inc. (BTHD) is an AI-augmented athlete transition and transformation platform helping professional, collegiate, and amateur athletes navigate life after sport. The Platform provides:

Athletes under 18 may access the BTHD Athlete Portal exclusively through a verified institutional agreement. See Section 4 for details.
The BTHD Athlete Portal (bthd.app/athlete) is available to athletes exclusively through institutions that have executed a valid BTHD Institutional Licensing Agreement.
Institutions are solely responsible for:
Athlete data accessed through the Athlete Portal is handled in accordance with FERPA and COPPA requirements as described in our Privacy Policy. BTHD does not market to, advertise to, or sell the personal information of athletes.
Athletes under 13 are strictly prohibited from accessing any BTHD service. If BTHD becomes aware of an athlete under 13 accessing the platform, the account will be immediately deactivated and all data deleted.
Schools, universities, sports organizations, player associations, and other institutions may license the BTHD platform under a separate Institutional Licensing Agreement. Institutional access is governed by both these Terms and the applicable Institutional Licensing Agreement. In the event of any conflict, the Institutional Licensing Agreement prevails.
Institutions are responsible for ensuring their administrators and enrolled athletes comply with these Terms. BTHD invoices institutions directly, and no in-app purchases are required for institutional access.
Institutional pricing is available in CAD and USD. Current pricing tiers are available at bthd.app.
To access certain features, you must register for an account. You agree to:
You may not transfer, sell, or assign your account to any other person or entity. BTHD reserves the right to terminate accounts that violate these Terms.
BTHD offers free and paid subscription tiers to individual athletes aged 18 and over. Current pricing is available on the Platform and is subject to change with advance notice.
Paid subscriptions automatically renew at the end of each billing period. By subscribing, you authorize BTHD to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through your account settings or by contacting harry@bthd.app. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of a billing period unless required by applicable law.
Individual subscriptions are billed in USD or CAD via the BTHD web platform. Institutional licensing is available in both CAD and USD as specified in the applicable Institutional Licensing Agreement.
Payment processing for web subscriptions is handled by Stripe. BTHD does not store full payment card information. In-app purchases are not used, and all billing occurs through the BTHD web platform at bthd.app.
BTHD may offer a free trial period for new users. At the end of the free trial, your account will not be automatically charged. Access to paid features will be suspended until you choose to upgrade. BTHD reserves the right to modify or discontinue free trial offers at any time.
The Platform allows users to post content in community areas such as the Huddle. By submitting content, you grant BTHD a non-exclusive, worldwide, royalty-free license to use and display such content solely in connection with operating the Platform. You are solely responsible for your content and represent that it does not violate any third-party rights or applicable law. BTHD reserves the right to remove any content at its sole discretion.

The Platform and all original content, features, AI models, assessment methodologies, athlete archetype frameworks, transition analysis systems, curriculum, and branding are the exclusive property of Bigger Than Hoop Dreams Inc. The BTHD name, logo, and "Bigger Than Hoop Dreams" mark are trademarks of Bigger Than Hoop Dreams Inc. You may not use these marks without prior written consent. BTHD grants you a limited, non-exclusive, non-transferable, revocable license to access the Platform solely for personal or internal business use in accordance with these Terms.
The Platform may contain links to third-party websites. BTHD does not control or endorse these sites and is not responsible for their content or practices. Your interactions with third-party sites are solely between you and those parties.
Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described therein.
BTHD's coaching and assessment tools are powered by artificial intelligence, including Anthropic's Claude API. AI-generated guidance is for informational and motivational purposes only and does not constitute professional career counselling, financial advice, legal advice, or psychological counselling. Athletes should consult qualified professionals for advice specific to their circumstances. BTHD does not guarantee employment outcomes or career transition results.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. BTHD DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AT ALL TIMES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BTHD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. BTHD'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO BTHD IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Bigger Than Hoop Dreams Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.
Before initiating formal proceedings, you agree to contact BTHD at harry@bthd.app with a written description of the dispute. Both parties will attempt informal resolution for 30 days. Unresolved disputes shall be settled by binding arbitration in Kitchener, Ontario, Canada, under the laws of the Province of Ontario and applicable federal laws of Canada. All proceedings are conducted on an individual basis, and no class actions are permitted.
BTHD may suspend or terminate your access at any time if we reasonably believe you have violated these Terms. You may terminate your account at any time by contacting harry@bthd.app. Sections 10, 14, 15, 16, and 17 survive termination.
We may update these Terms at any time. Material changes will be communicated by updating the date above and notifying registered users by email. Continued use of the Platform after changes take effect constitutes acceptance.
